Surety

A surety is the company that issues your performance and payment bonds, the financial guarantee a GC or owner requires that you'll complete a job and pay your subs and suppliers. Your surety decides your bonding capacity, the single and aggregate size of job you're approved to bond, based partly on your financial statements and partly on your safety record, including your EMR (experience modification rate). A rising mod can lead your surety to hold your bonding program where it is, or grow it more slowly than planned, sometimes before any GC has rejected a bid over the same number. A good surety agent functions less like a gatekeeper and more like an ally who wants your program to grow, and bringing them your current worksheet and loss runs, along with an explanation of anything driving a rising mod, helps them advocate for you with their own underwriters. Sureties typically review your program at least once a year, which is often the first place a mod problem shows up in a way that affects your business, even before it costs you a bid.
